Smart Services Terms and Conditions
Smart Services maintains the smartservices.me Website (“Site”). The following are the terms of use that govern the use of the Site (“Terms of Use”). By using the Site, you expressly agree to be bound by these Terms of Use and the smartservices.me privacy policy and to follow these Terms of Use and all applicable laws and regulations governing the use of the Site. The Company reserves the right to change these Terms of Use at any time, effective immediately upon posting on the Site. Please check this page of the Site periodically. The Company will note when there are updates to the Terms of Use at the bottom of the Terms of Use.
Payment
Smart Services accepts payment by Visa or MasterCard debit and credit cards in United Arab Emirates currency (AED) for their products and services. All online purchases are also governed by the terms and conditions of respective merchant service provider. Please review respective merchant service provider’s user agreement and privacy policy before entering any transaction. Interpretation. These Terms of Use supersede all other written and oral communications or agreements with regard to the subject matters discussed in these Terms of Use. A waiver or modification of these Terms of Use will only be effective if made in writing signed by an authorized officer of Smart Services. All refunds will be made onto the original mode of payment.
Unless stated in writing otherwise, all fees and charges are nonrefundable. Smart Services may change the fees and charges then in effect, or add new fees or charges based on market requirements.
MULTI-CURRENCY PRICED TRANSACTION:
The displayed price and currency selected by you will be the same price and currency charged to the Card and printed on the Transaction Receipt.
Modifications to terms of service and service
Smart Services may change the terms and conditions of the Service from time to time. Upon any such change, The Company will notify the Customer by posting the changes to the site from which the Service was purchased. The Company reserves the right to modify or discontinue the Service with or without notice to Customer. Smart Services shall not be liable to Customer or any third party should they exercise their right to modify or discontinue the Service. Customer’s use of the Service constitutes an affirmative agreement by Customer to abide and be bound by these Service Terms and its modifications.
Privacy Policy
Smart Services value the relationship they have with their customers and are committed to responsible information-handling practices. The Company takes great care in safeguarding your personal information and in complying with all applicable privacy laws and our own internal standards and best practices. As part of your interaction with Smart Services, they may collect personal information such as contact information, including name, address, phone number, e-mail address and image. They may use images of the customer in their premises or on their social media accounts for marketing purposes.
The customer has the full right to ask Smart Services to remove any photo placed on social media accounts or other marketing initiatives.
Smart Services may also contact customers periodically to inform them of company services and promotions. Customers can unsubscribe from those notifications at any point.
Customer’s responsibility to backup data
Customer agrees that prior to Smart Services servicing any Customer equipment it is Customer’s responsibility to (1) back-up the data, software, information or other files stored on Customer’s computer disk drives, peripherals, phone and/or on any other electronic storage device; and (2) remove all videotapes, compact disks, floppy disks, laser disks, cassettes, DVDs, film or other media from Customer’s product. Customer agrees that whether or not Customer requests backup services from us. Smart Services shall not be liable under any circumstances for any loss, disclosure, alteration or corruption of any data, software, information, files, videotapes, compact disks, floppy disks, laser disks, cassettes, DVDs, film or other media.
Uncollected Products
If a customer does not claim his/her product within 30days of being contacted by Smart Services with an evaluation or after the product has been fixed and the customer has been informed of the same, they reserve the right to dispose of the device without being held liable or responsible. They will make attempts to contact the customer via call, SMS or email. If repeated attempts to do so have been unsuccessful they will discard the product. By using their service and therein accepting these terms, the customer forfeits his right to claim the product and or damages after the stipulated 30-day notice period. No refund on the service or value of the product will be made after the stipulated 30-day notice period.
Limitations to service
Smart Services shall not be liable for any failure or delay in performance due to any cause beyond its control. They reserve the right to refrain from providing the Services ordered and instead refund Customer’s payment, wholly or in part, on the basis that the minimum system requirements are not met or the technical needs (including wiring or overcoming physical or technical barriers) or other requirements of the Customer are unusual or extensive and beyond the scope of the Service, as determined by Smart Services.
Indemnification
Customer agrees to indemnify, defend, and hold harmless Smart Services (and its affiliates and their respective officers, directors, employees and agents) from and against any and all losses, costs, obligations, liabilities, damages, actions, suits, causes of action, claims, demands, liens, encumbrances, security interests, settlements, judgments, and other expenses, (including but not limited to cost of defense, settlement, and reasonable attorneys’ fees) of whatever type or nature, including, but not limited to, damage or destruction to property, injury (including death) to any person or persons, which are asserted against, incurred, imposed upon or suffered by them by reason of, or arising from: (a) Customer’s breach of this Agreement; (b) Customer’s actual or alleged infringement of any patent, copyright, trademark, trade secret or other property or contract right of any other person; (c) Customer’s actual or alleged failure to promptly pay sums due Smart Services (d) Customer’s failure to comply with applicable laws, regulations or ordinances; or (e) the acts or omissions of Customer (or its officers, directors, employees or agents).

The customer will be charged an initial inspection fee of AED 25 to be paid by the customer during the time of booking the service/services, the amount will deduct from the final total Quotation/invoice amount.
Service Cancellation policy
Customer will be charged AED 25 if the cancellation is after the product has been picked up. Full service fees will be applicable if the repair/ service has been completed. Request to cancel the service will not be permitted on the scheduled day of product pickup. Any service cancellation request before the scheduled day of product pickup has to be made by the customer by contacting Smart Services on

DISCLAIMER OF WARRANTY, LIMITATION OF DAMAGES
Smart serivces makes no warranty or representation of any kind, either express or implied, including but not limited to warranty of title or non-infringement or implied warranty of merchantability, fitness for a particular purpose, non-infringement or other violation of rights in relation to the availability, accuracy, validity, reliability or content of these pages and/or the site. Company also does not make any representation or warranty regarding the accuracy or reliability of any advice, opinion, statement or other information that is submitted, displayed or uploaded to the site by any user. Company shall not be liable for any direct, indirect, incidental, special or consequential damages, lost profits or for business interruption arising out of the use of or inability to use this site, even if Smart Services has been advised of the possibility of such damages. Some jurisdictions do not allow exclusion of certain warranties or limitations of liability, so the above limitations or exclusions may not apply to you. The liability of Smart Services would in such case be limited to the greatest extent of liability permitted by law.
LIMITATION OF LIABILITY
Smart serivces shall not be liable for any direct, indirect, incidental, special or consequential damages, resulting from the use or the inability to use the service or for cost of procurement of substitute goods and services or resulting from any goods or services purchased or obtained or messages received or transactions entered into through the service or resulting from unauthorised access to or alteration of customer’s transmissions or data, including but not limited to, damages for loss of profits, use, data or other intangible, even if Smart Services has been advised of the possibility of such damages. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages o some of the above limitations may not apply to each customer.
APPLICABLE LAW
The Laws of the United Arab Emirates shall govern the use of the Site and the Terms of Use, without regards to conflict of laws principals. All disputes arising in connection therewith shall be heard only by a court of competent jurisdiction in the U.A.E.
SITE OPERATION
The United Arab Emirates is our Country of Domicile. Smart Services controls this Site from the U.A.E. The company makes no representation that this Site is appropriate for use in other locations. If you use this Site from other locations, you are responsible for ensuring compliance with local laws. You may not use, export or re-export any materials from this Site in violation of any applicable laws or regulations, including, but not limited to any U.A.E export laws and regulations.
OFFICE FOREIGN ASSETS CONTROL (OFAC) SANCTIONED COUNTRIES
Smart Services will not trade with or provide any services to individuals and companies owned or controlled by or acting for or on behalf of, OFAC targeted countries AND individuals, groups, and entities, such as terrorists and narcotics traffickers designated under the OFAC programs that are not country specific.
REPRESENTATIONS BY YOU
By visiting the Site, you represent, warrant and covenant that (a) you are at least 18 years of age; (b) that all materials of any kind submitted by you to Smart Services through the Site or for inclusion on the Site will not plagiarize, violate or infringe upon the rights of any third-party including trade secret, copyright, trademark, trade dress, privacy, patent, or other personal or proprietary rights. The customer using the website who are Minor /under the age of 18 shall not register as a User of the website and shall not transact on or use the website.
PERMITTED USE
You agree that you are only authorized to visit, view and to retain a copy of pages of this Site for your own personal use, that you shall not duplicate, download, publish, modify or otherwise distribute the material on this Site for any purpose other than for personal use, unless otherwise specifically authorized by Smart Services to do so. You also agree not to deep-link to the site for any purpose, unless specifically authorized by Smart Services to do so. The content and software on this Site is the property of Smart Services. The cardholder must retain a copy of transaction records and policies and rules.
YOUR ACCOUNT
If you use the Smart Services Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your account from any devices, and you agree to accept responsibility for all activities that occur under your account or password. The Site shall not be responsible or liable, directly or indirectly, in any way for any loss or damage of any kind incurred as a result of, or in connection with, your failure to comply with this section.
NO COMMERCIAL USE
This Site may not be used by you for any commercial purposes such as to conduct sales of merchandise or services of any kind. You must obtain Smart Services prior written consent to make commercial offers of any kind on the Site, whether by advertising, solicitations, links, or any other form of communication. The company will investigate and take appropriate legal action against anyone who violates this provision, including without limitation, removing the offending communication from the Site and barring such violators from use of the Site.
COPYRIGHT POLICY

INTELLECTUAL PROPERTY

You agree that monetary damages may not provide a sufficient remedy to the company for violations of these Terms of Use and you consent to injunctive or other equitable relief for such violations. INDEMNITY
You agree to indemnify and hold Smart Services, its subsidiaries, affiliates, officers, agents and other partners and employees, harmless from any loss, liability, claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of or relating to your use of the Site, including also your use of the Site to provide a link to another site or to upload content or other information to the Site, or your breach of the Terms of Use.
ADVERTISING
The Site may contain advertisements and/or sponsorships. The advertisers and/or sponsors that provide these advertisements and sponsorships are solely responsible for ensuring that the materials submitted for inclusion on the Site are accurate and comply with all applicable laws. Smart Services is not responsible for the acts or omissions of any advertiser or sponsor.
SEVERABILITY
If any provision of the Terms of Use is held to be invalid, void or unenforceable, the remaining provisions shall nevertheless continue in full force and effect.
